La formación docente es indispensable para responder a los requerimientos de la compleja sociedad actual. De su conocimiento, iniciativa, praxis y creatividad depende el éxito o el fracaso del sujeto que aprende. Al modificar el rol del docente se transforma la actitud de los estudiantes. ¿Cómo entender la formación filosófica transdisciplinar? Este texto responde a este y otros cuestionamientos: ¿cuáles son los planteamientos pedagógicos afines a la era digital? ¿en qué medida las TIC se encuentran al servicio de una filosofía (...) educativa transdisciplinar?, ¿cómo se explica ese enfoque en la formación del docente?, ¿cuál es la función de la formación en la innovación educativa?, ¿cómo formar para la ciudadanía mundial?, ¿cuáles son las contribuciones de las nuevas ciencias para la formación educativa? El crecimiento exponencial de la ciencia y de la tecnología nos obliga a pensar en procesos formativos innovadores. En tal sentido, resulta imprescindible el estudio de estas problemáticas. (shrink)

Escribir hoy en día un libro sobre hermenéutica, que tal hermenéutica se refiera a la desarrollada por G. Gadamer en su conocido Verdad y método y que se pretenda añadir algo nuevo a lo mucho escrito sobre el tema parecería, a primera vista, empresa irrealizable. Que ambas pretensiones inspiren la sólida monografía de María G. Navarro —titulada Interpretar y argumentar— constituye empresa audaz y arriesgada, plena de coraje innovador, que provoca admiración, curiosidad e interés. Contra lo que pudiera parecer (...) a primera vista, el libro contiene un alto componente de originalidad y creatividad, debido a la estratagema metodoló-gica de que se sirve la autora. A saber, una hermenéutica in obliquo, estrategia consistente en interpretar a la hermenéutica gadameriana a través del prisma de la lógica de la argumentación. (shrink)

En la actualidad se producen cambios vertiginosos y el derecho no se encuentra inmune a ellos. Desde este punto de vista, es importante conocer lo que pensadores de referencia en la actualidad han dicho sobre las últimas transformaciones. Este ensayo repasa las contribuciones de filósofos tan relevantes como E. Voegelin, R. Girard, J.Habermas, R. Brague o B-Ch. Han, mostrando su reflexión sobre el hombre y cómo ello repercute en la comprensión del derecho y otras instituciones humanas. La obra aporta una (...) visión original, ya que busca reconstruir la filosofía del derecho partiendo de una nueva formulación de sus fundamentos últimos y revelando la conexión entre la filosofía jurídica, la antropología y la metafísica. En 1960 ingresaba José María Haro Salvador en la Real Academia Valenciana de Jurisprudencia y Legislación con un discurso titulado «Relaciones y fronteras entre la Caridad y la Justicia». Tomaba cuerpo ahí la experiencia dilatada de un jurista cuya pasión por lo social le había conducido de forma absolutamente natural desde su juventud hacia los problemas jurídicos relacionados con el mundo del trabajo y la promoción social de los obreros. Era en una época, además, marcada por un importante (...) proceso de institucionalización de organismos públicos, procedimientos y discursos sin referencia a los cuales no se entendería en muy buena medida la España del presente. En este proceso tuvo también José María Haro un papel decisivo, tanto por su labor en la magistratura del trabajo, de la que fue primer titular en la Valencia de la postguerra, como en el Instituto Nacional de Previsión (I. N. P.), cuya delegación provincial comenzó a presidir en 1950. Ahí encontró un canal extraordinario para la proyección de sus ideales sociales, germinados en el suelo del magisterio pontificio y de la tradición del catolicismo social que tan importante impulso recibió en Valencia entre los siglos XIX y XX, gracias a las figuras insignes del P. Antonio Vicent, Antonio y Rafael Rodríguez de Cepeda, Juan Reig Genovés y muchos otros. De todos ellos se declara en débito José María Haro a lo largo de las páginas que componen este libro, muchas de ellas publicadas hoy por primera vez, más de medio siglo después de su redacción. Sin duda el paso del tiempo se hará notar en muchas de estas ideas, que necesariamente deben ser leídas en su contexto. En estos últimos cincuenta años han sido enormes los cambios producidos en el terreno de las ideas tanto como en el de las instituciones. Las leyes se suceden, las obras se transforman, algunas incluso mueren, pero los principios permanecen, porque no tienen su fuente en las circunstancias, necesariamente variables, de nuestra condición histórica, ni en las orientaciones particulares de una determinada política o de un régimen. Al contrario, beben del Evangelio y del derecho natural, de cuya síntesis y vitalidad es todo este libro un penetrante y constante reclamo. (shrink)

Esta obra compila los estudios presentados en las I Jornadas de Filosofía del Instituto CEU de Humanidades Ángel Ayala y está prologada por Abelardo Lobato, O. P. Los filósofos tienen el deber de buscar y alcanzar la verdad apelando a las fuerzas de la razón, la cual, por cierto, no impide otras vías genuinas de conocimiento, como la fe. La búsqueda intelectual exige un trabajo de análisis que debe afinarse ante las obcecaciones que a menudo se interponen en el horizonte (...) de la existencia humana. En no pocos momentos de la historia ha habido claudicaciones generalizadas ante esa búsqueda, olvidos más o menos conscientes de que las verdades se alcanzan si se mantiene la esperanza de sabiduría y el amor a ella. El relativismo y el escepticismo se presentan casi como el polo opuesto de esa esperanza y ese amor; como una consecuencia de la “con-fusión” cultural, de las mentiras interesadas y de la desidia moral de algunas sociedades. La nuestra, la europea occidental, es una de ellas. El relativismo afecta al modo de pensar y de comportarse del hombre y es habitual que le lleve por vericuetos que a la postre terminan dañándole a él y a sus congéneres. En este libro se analizan algunos errores que han llevado a suscribir las tesis del relativismo y a rechazar la posibilidad de dar con algunas verdades comunes para todos. La obra tiene dos partes, una histórica y otra temática. Las páginas con enfoque histórico estudian las tesis que sobre el relativismo han mantenido algunos pensadores o corrientes de la filosofía. De su lectura se puede extraer la conclusión de que el fenómeno del relativismo es tan viejo y tan actual como el propio hombre y su apertura inteligente a la verdad. Filósofos de la época antigua de la talla de Protágoras, Pirrón o los “Académicos” coetáneos de San Agustín; modernos como Descartes; contemporáneos como Wittgenstein o Kuhn han dejado huellas que luego abrieron el camino hacia un régimen de pensamiento en que el hombre abandona la posibilidad de admitir verdades universales. Algunos argumentos favorables al relativismo —y, más aún, algunas actitudes “propedéuticas” de él— se han ido instalando culturalmente hasta consolidarse de manera cada vez más indiscutida. La segunda parte analiza el relativismo de forma temática, como un asunto abordable desde las diversas ramas del saber filosófico. Así, se tratan las repercusiones que tiene esta forma de pensamiento en la pragmática, la lógica, la estética o la religión, y se intentan desenmascarar los tópicos y falsos argumentos que justifican un comportamiento ético o religioso “abierto a todas las opciones”. Philosophers have assumed that as long as discriminatory admission and exclusion policies are off the table, it is possible for one to adopt a restrictionist position on the issue of immigration without having to worry that this position might entail discriminatory outcomes. The problem with this assumption emerges, however,when two important points are taken into consideration. First, immigration controls are not simply discriminatory because they are based on racist or ethnocentric attitudes and beliefs, but can themselves also be the source (...) of social and civic ostracism. Second, by focusing so much on questions of admission and exclusion, philosophers have tended to overlook the discriminatory potential of immigration enforcement mechanisms. In this essay, I make the case that philosophers who deal with the issue of immigration cannot dispense with the potential for discrimination in a state's enforcement mechanism as easily as they have with the potential for discrimination in a state’s admission and exclusions criteria. In addition, I put forth the positive claim that the way to combat this potential for discrimination (e.g., xenophobia) must begin with a defense of, and advocacy for, immigrant rights. (shrink)

Since at least the second half of the 19th century, the U.S. federal government has enjoyed “plenary power” over its immigration policy. Plenary power allows the federal government to regulate immigration free of judicial review and thereby, with regard to immigration cases, minimize the Constitutional protections afforded to non-citizens. The justification for granting the U.S federal government such broad powers comes from a certain understanding of sovereignty; one where limiting sovereign authority in cases like immigration could potentially undermine its legitimacy (...) and thereby lead to something like a Hobbesian “state of nature.” One of the potential downsides of allowing the federal government to have such broad powers, however, is the potential to place non-citizens in a situation analogous to what Giorgio Agamben has called the “state of exception.” This situation appears to leave us with the following dichotomy: without something like the plenary power doctrine a political community will end up with a state of nature, but with something like the plenary power doctrine they end up with a state of exception. This essay offers a two-part response to this dilemma. First, it argues that the plenary power doctrine goes against the spirit of the U.S. Constitution, specifically the Fourteenth Amendment. Non-citizens, even undocumented immigrants, are entitled to more Constitutional protections than they currently enjoy. Second, since extending these protections is more consistent with the spirit of the Constitution, I argue that curtailing the federal government’s power over matters of immigration does not undermine its sovereignty, but promotes it. In short, with regard to immigration, it is a false but seductive dichotomy that constitutional democracies must choose between a state of nature and a state of exception. (shrink)

In this article, I broadly sketch out the current philosophical debate over immigration and highlight some of its shortcomings. My contention is that the debate has been too focused on border enforcement and therefore has left untouched one of the more central issue of this debate: what to do with unauthorized immigrants who have already crossed the border and with the “push and pull” factors that have created this situation. After making this point, I turn to the work of Enrique (...) Dussel and argue that his philosophical approach offers some insights that can help overcome these shortcomings. In particular, Dussel’s commitment to a social critique and transformation that begins with the material grievances of the most excluded and oppressed in a community. Under this type of approach, the immigration debate would begin with the grievances of the victims of immigration polices and reform (i.e. unauthorized immigrants) instead of with concerns for how to better enforce borders. Lastly, I point out that this type of approach is consistent with the current Immigrant Rights Movement in the United States. (shrink)

In debating the ethics of immigration, philosophers have focused much of their attention on determining whether a political community ought to have the discretionary right to control immigration. They have not, however, given the same amount of consideration to determining whether there are any ethical limits on how a political community enforces its immigration policy. This article, therefore, offers a different approach to immigration justice. It presents a case against legitimate states having discretionary control over immigration by showing both how (...) ethical limits on enforcement circumscribe the options legitimate states have in determining their immigration policy and how all immigrants (including undocumented immigrants) are entitled to certain protections against a state’s enforcement apparatus. In this article I use the tropes of El Cucuy (the Mexican version of the boogyman), La Llorona (the wailer), and La Migra (the border patrol) to provide the beginnings of an ethical critique of the treatment of undocumented immigrants in the United States.

This essay argues that we should find Crimmigration, which is the collapsing of immigration law with criminal law, morally problematic for three reasons. First, it denies those who are facing criminal penalties important constitutional protections. Second, it doubly punishes those who have already served their criminal sentence with an added punishment that should be considered cruel and unusual (i.e., indefinite imprisonment or exile). Third, when the tactics aimed at protecting and serving local communities get usurped by the federal government for (...) immigration enforcement purposes, they often undermine these original aims or get used in ways that conflict with the U.S. Constitution. These concerns should prompt us therefore either to reject the government’s plenary power over immigration or require the federal government to be more consistent about maintaining the separation between criminal law and immigration law. In this essay, I argue that even when they appear to help, restrictions on migration are usually only an impediment, not an aid, to cosmopolitan justice. Even though some egalitarian cosmopolitans are well intentioned in their support of migration restrictions, I argue that migration restrictions are (i) not truly cosmopolitan and (ii) will not have the kinds of consequences they expect. My argument in defense of this claim begins, in section 1, by outlining a defense of migration restrictions based on (...) egalitarian cosmopolitan grounds. Then in sections two and three, I reply to the harms this position associates with open borders and provide some reasons as to why restrictions on migration are incompatible with cosmopolitan justice. Given the oncoming demographic changes—which are primarily driven by the growth in the Latinx community—the United States is predicted to become a minority-majority country by around 2050. This seems to suggest that electoral strategies that employ “dog-whistle” politics are destined for the dust-bin of history. Following the work of critical race theorists, such as Ian Haney-Lopez and Derrick Bell, I want to suggest that pronouncing the inevitable demise of dog-whistle politics is premature. This is because there are reasons to suspect (...) that certain segments of the Latinx community—much like the Southern and Eastern Europeans in the early part of 20th Century—might be co-opted into American whiteness. The social trust argument asserts that a political community cannot survive without social trust, and that social trust cannot be achieved or maintained without a political community having discretionary control over immigration. Various objections have already been raised against this argument, but because those objections all assume various liberal commitments they leave the heart of the social trust argument untouched. This chapter argues that by looking at the socio-historical circumstances of Latino/as in the United States, an inherent weakness of the (...) social trust argument gets exposed. Giving a political community discretionary control over immigration not only fails to deliver on the promise of social trust, but it actually seems to promote its opposite, social mistrust. This suggests that a far better way of promoting the goal of social trust, and at the same time abating social mistrust, is to actually circumvent a political community’s ability to control immigration by giving priority both to socio-historical circumstances and immigrant rights (at least in a minimalist sense) in determining immigration policy. In 2008 Robert Lovato coined the phrase Juan Crow. Juan Crow is a type of policy or enforcement of immigration laws that discriminate against Latino/as in the United States. This essay looks at the implications this phenomenon has for an ethics of immigration. It argues that Juan Crow, like its predecessor Jim Crow, is not merely a condemnation of federalism, but of any immigration reform that has stricter enforcement as one of its key components. Instead of advocating for increased enforcement, (...) I want to suggest that just immigration reform must adhere to two standards, equality of burdens and universal protections, and that only by doing so can the potential for Juan Crow be adequately avoided. This study aims to investigate the relationship between job burnout and employee performance in the feed industry during the ASF outbreak. Further, the researchers employed a descriptive-correlational research design in order to analyze the acquired data and produce pertinent findings. Thus, the researchers gathered data from one hundred two (102) feed industry employees. The Maslach Burnout Inventory (MBI) and Individual Work Performance Questionnaire (IWPQ) were employed to ascertain the extent of job burnout experienced by the respondents and evaluate employee performance, (...) respectively. Based on the statistical analysis, there is a significant relationship between job burnout and employee performance. Moreover, the study's findings were thoroughly analyzed and discussed. (shrink)

In their article, “Immigrant legalization: A Dilemma Between Justice and The Rule of Law,” Sarah Song and Irene Bloemraad address rule of law objections to policies that would regularize the status of undocumented immigrants in the United States. On their view, justice requires that liberal democratic states (i.e., states that are committed to individual liberty and universal equality) provide pathways for undocumented immigrants to regularize their status. We do not disagree with Song and Bloemraad’s account: rule of law and regularization (...) policies are not inconsistent, and in fact regularization supports rule of law, when properly understood. Our view is that there needs to be a deeper investigation into the motivations of “rule of law” objections considered in Song and Bloemraad’s account. We argue that the real purpose of these objections is not necessarily to serve as an alternative to the justice-based claims of undocumented immigrants, but as a way to undermine them. On our account, these rule of law objections accomplish this undermining task through the mechanisms of dog whistling, discrediting and distorting, and ostracizing. (shrink)

Mostraremos que el desacuerdo entre pesimistas y optimistas sobre la resolución racional de los desacuerdos profundos no se ubica en el nivel del contenido, de lo que están diciendo, sino en uno diferente. Para mostrar por qué es así, proponemos detenernos en el funcionamiento lógico-semántico del término clave en este desacuerdo: “racional”. Iniciaremos con el repaso de algunos argumentos que pesimistas y optimistas han esgrimido en su discusión, y comprobaremos la diferencia de estándares ya mencionada (sección 1); luego, nos detendremos (...) en las particularidades lógico-semánticas de “racional”, y explicitaremos lo que hacen los hablantes cuando realizan movidas lingüísticas con él (sección 2); y para finalizar, volveremos sobre el desacuerdo entre pesimistas y optimistas, y mostraremos por qué, a pesar de la diferencia, permanece como un desacuerdo genuino y es importante seguir inmiscuidos en esta discusión. El análisis lógico-semántico nos mostrará que “racional” no es usado para describir un estándar de racionalidad independiente de cualquier contexto, sino para expresar ciertas actitudes respecto de lo que decimos o hacemos. A pesar de la diferencia de estándares, pesimistas y optimistas siguen inmiscuidos en un desacuerdo genuino porque discrepan acerca de ciertas actitudes que hay que adoptar con respecto a, en este caso específico, los DP. In this Interview, Professor Robert B. Brandom answered ten detailed questions about his philosophy of Rational Pragmatism and Semantic Expressivism, grouped into four topics. 1. Metaphysics and Anthropology, 2. Pragmatics and Semantics, 3. Epistemic Expressivism and 4. Philosophy of Logic. With his careful answers Professor Brandom offers many additional insights into his rigorously constructed account of the relationship “between what we say and think, and what we are saying and thinking about” around the human practice of asking for and giving (...) reasons. A final, additional question pointed at a principal motivation for putting together the present issue: how to reconcile Wittgenstein’s assertion that philosophy must not proffer any theories with the very explicit system of explanations Brandom has constructed. This same issue is addressed to some extent already in Professor Brandom’s new article contained in this issue, but his answer, asserting that he does not proffer a theory but only makes explicit what is already there, might be seen as an unambiguous statement of the continuous presence of a contested Wittgensteinian principle in Brandom’s work. Book review of Elizabeth F. Cohen's Illegal: How America’s lawless immigration regime threatens us all.

The current assessment of behaviors in the inventories to diagnose autism spectrum disorders (ASD) focus on observation and discrete categorizations. Behaviors require movements, yet measurements of physical movements are seldom included. Their inclusion however, could provide an objective characterization of behavior to help unveil interactions between the peripheral and the central nervous systems. Such interactions are critical for the development and maintenance of spontaneous autonomy, self-regulation and voluntary control. At present, current approaches cannot deal with the heterogeneous, dynamic and stochastic (...) nature of development. Accordingly, they leave no avenues for real-time or longitudinal assessments of change in a coping system continuously adapting and developing compensatory mechanisms. We offer a new unifying statistical framework to reveal re-afferent kinesthetic features of the individual with ASD. The new methodology is based on the non-stationary stochastic patterns of minute fluctuations (micro-movements) inherent to our natural actions. Such patterns of behavioral variability provide re-entrant sensory feedback contributing to the autonomous regulation and coordination of the motor output. From an early age, this feedback supports centrally driven volitional control and fluid, flexible transitions between intentional and spontaneous behaviors. We show that in ASD there is a disruption in the maturation of this form of proprioception. Despite this disturbance, each individual has unique adaptive compensatory capabilities that we can unveil and exploit to evoke faster and more accurate decisions. Measuring the kinesthetic re-afference in tandem with stimuli variations we can detect changes in their micro-movements indicative of a more predictive and reliable kinesthetic percept. Our methods address the heterogeneity of ASD with a personalized approach grounded in the inherent sensory-motor abilities that the individual has already developed. (shrink)

Reflection on the nature and value of fiction has often paid attention to the possibility of acquiring knowledge through engaging with fictional works. The alleged imaginative character of fiction appreciation and the sort of emotional responses that fiction is able to prompt in the viewer have been frequently invoked in order to explain the peculiar cognitive value that fictions may possess. In this paper, I would like to question whether fiction as such possesses a specific kind of value. Although I (...) agree that fictional works can convey certain kinds of knowledge, I think that the cognitive virtues that we attribute to fictional works do not have much to do with their fictional character as such. Rather, these values are grounded upon the various properties that the different representational artifacts that can serve to produce fictional works possess. Thus while I think fictional works can deliver various sorts of cognitive value, this value is not intrinsically connected with the fictional nature of these works. (shrink)

This is a review of Serena Parekh's book: Refugees and the Ethics of Forced Displacement.

In this paper I present an overview of the doctrine known as Positive Aesthetics regarding aesthetic judgements about nature. According to this view, all pristine nature is always beautiful and, generally, although not necessarily, human intervention tends to introduce ugliness in nature. One of the strong practical motivations behind this claim is an attempt to ground our reasons to preserve natural environments in aesthetic reasons. Positive Aesthetics has been defended within contrary approaches to nature appreciation such as the cognitivists and (...) the anti-cognitivist. Recently, the possibility of real ugliness in nature has been defended; at the same time, it is argued that the presence of ugly items in nature does not lead necessarily to the idea that they are not aesthetically valuable. Hence, natural ugliness can be a reason to preserve nature. In this sense, the denial of the Positive Aesthetics claim is shown to be compatible with the appeal to aesthetic negative qualities as a source of reasons for preserving natural environments. In this paper I will try to trace a discussion about status of art in some recent theories, which pay special attention to the fact that artworks are the kind of things to which representational, expressive, and aesthetic properties are ascribed. First, I will briefly mention some already established criticisms—developed by Richard Wollheim1—against the idea that artworks cannot be identified with physical objects. These criticisms have the further aim of providing an account of art experience that includes our perceiving representational (...) and expressive properties as well as aesthetic ones in artworks. In Wollheim's view, a misconstruction of the nature of these properties and of our perception of them in artworks has been the main reason for the view he intensely criticizes. Thus, he offers a different understanding of these properties, which also involves a new account of perception that does not require an idealisation of our experience of art. (shrink)

Nacer supone para esta conciencia un pecado y la realidad material representa para ella un lugar de exilio, extrañeza y alienación. Sin embargo, cuando uno retrocede sobre la protohistoria de la conciencia humana, sorprende la determinación de integridad y sacralidad que el pensamiento primitivo le atribuye a lo real. Para la conciencia primitiva, (...) la realidad nace en el parto de un seno infinito que la alimenta, cobija y bendice sus propios frutos. En lo que sigue, intentaremos remontarnos a la protohistoria de esta conciencia a fin de reconsiderar las condiciones de posibilidad de la inocencia metafísica y ética, o bien, el modo de ser de la inocencia original. Transference theorists propose to explain causation in terms of the transference of a physical element. I argue, in two steps, that this is not possible. First, I show that available accounts of ‘transference’ ultimately convey that transference -and, consequently, causation- is the (non-relational) identity over time of the transferred element (a universal, a trope, or even an absolute substance). But, second, I try to defend, it is conceptually impossible that causation is (non-relational) identity.

Se ofrece en este artículo una perspectiva de la educa- ción inclusiva a partir de la concepción de las injusticias epistémicas de Fricker. Se pregunta cuál es la relación entre la educación inclusiva y la in- justicia epistémica en el caso de estudiantes con deficiencias mentales. Es necesario adaptar las tesis de Fricker a este caso límite, por lo que se debe pensar la injusticias epistémicas a partir (...) del modelo social de la discapaci- dad. ABSTRACT – Epistemic Injustice in the Education of People with Mental Disabilities. This article offers a perspective on inclusive education based on Fricker’s conception of epistemic injustice. What is the relationship be- tween inclusive education and epistemic injustice in the case of students with mental deficiencies? By adapting Fricker’s thesis to this extreme case, epistemic injustice can be explored via the social model of disability (SMD). This research was carried out in order to verify by simulation Mendel’s laws and seek for the clarification, from the author’s point of view, the Mendel-Fisher controversy. It was demonstrated from: the experimental procedure and the first two steps of the Hardy-Weinberg law, that the null hypothesis in such experiments is absolutely and undeniably true. Consequently, repeating hybridizing experiments as those showed by Mendel, it makes sense to expect a highly coincidence between the observed and the expected cell frequencies. By (...) simulation, 30 random samples were generated with size equal to the number of observations reported by Mendel for his single trait trial, in this case, seed shape; assuming complete dominance, with genes A and a; likewise, it was simulated the results for the experiment with two traits, segregating in separate chromosomes, in this case seed shape, as before, and albumen color, with genes B and b, both loci with complete dominance. In the case of a single trait, the data only showed evidence for rejecting the null hypothesis (Ho ) in 1/30 samples, with (P<0.05). In the case of the 30 samples of the two traits experiment, (Ho ) was rejected only on 3/30 times, when it was set a = 0.05. In both simulations there was a high correspondence between the observed and expected cell frequencies, which is simply due to the fact that (Ho ) is true, and under these conditions, that is what would to expect. This booklet on Active Assisted Living (AAL) technologies has been created as part of the GoodBrother COST Action, which has run from 2020 to 2024. COST Actions are European research programs that promote collaboration across borders, uniting researchers, professionals, and institutions to address key societal challenges. GoodBrother focused on ethical and privacy concerns surrounding video and audio monitoring in care settings. The aim was to ensure that while AAL technologies help older adults and vulnerable individuals, their privacy and data protection (...) rights remain a top priority. This booklet is designed to guide you through the role that AAL technologies play in improving the quality of life for older adults, caregivers, and people with disabilities. AAL technologies offer tools for those facing cognitive or physical challenges. They can enhance independence, assist with daily routines, and promote a safer living environment. Las prioridades estratégicas que definió la Organización Mundial de la Salud para su labor en la década 2020-2030 son el sustrato de este trabajo. El mismo grupo interdisciplinario de profesionales de la salud que reflexionó en la primera entrega sobre las prioridades relacionadas con lograr poblaciones más sanas, continúa con otras prioridades orientadas a lograr una cobertura sanitaria universal y un mejor manejo de las emergencias sanitarias. En las conclusiones de la segunda entrega se destaca la importancia de desarrollar cada (...) una de las prioridades involucrando a la sociedad civil, la familia y los medios de comunicación. La manera de hacerlo será haciendo girar todas las iniciativas de ejecución alrededor de estrategias educativas adecuadamente planteadas en todos los niveles, sin que se admitan injerencias ni presiones, para recuperar así la confianza necesaria para conseguir las soluciones que son buenas para el ser humano, el ecosistema y las futuras generaciones. -/- . Ambient assisted living technologies are increasingly presented and sold as essential smart additions to daily life and home environments that will radically transform the healthcare and wellness markets of the future. An ethical approach and a thorough understanding of all ethics in surveillance/monitoring architectures are therefore pressing. AAL poses many ethical challenges raising questions that will affect immediate acceptance and long-term usage. Furthermore, ethical issues emerge from social inequalities and their potential exacerbation by AAL, accentuating the existing access gap between (...) high-income countries and low and middle-income countries. Legal aspects mainly refer to the adherence to existing legal frameworks and cover issues related to product safety, data protection, cybersecurity, intellectual property, and access to data by public, private, and government bodies. Successful privacy-friendly AAL applications are needed, as the pressure to bring Internet of Things devices and ones equipped with artificial intelligence quickly to market cannot overlook the fact that the environments in which AAL will operate are mostly private. The social issues focus on the impact of AAL technologies before and after their adoption. Future AAL technologies need to consider all aspects of equality such as gender, race, age and social disadvantages and avoid increasing loneliness and isolation among, e.g. older and frail people. Finally, the current power asymmetries between the target and general populations should not be underestimated nor should the discrepant needs and motivations of the target group and those developing and deploying AAL systems. Whilst AAL technologies provide promising solutions for the health and social care challenges, they are not exempt from ethical, legal and social issues. A set of ELSI guidelines is needed to integrate these factors at the research and development stage. (shrink)

It is a matter of fact that Europe is facing more and more crucial challenges regarding health and social care due to the demographic change and the current economic context. The recent COVID-19 pandemic has stressed this situation even further, thus highlighting the need for taking action. Active and Assisted Living technologies come as a viable approach to help facing these challenges, thanks to the high potential they have in enabling remote care and support. Broadly speaking, AAL can be referred (...) to as the use of innovative and advanced Information and Communication Technologies to create supportive, inclusive and empowering applications and environments that enable older, impaired or frail people to live independently and stay active longer in society. AAL capitalizes on the growing pervasiveness and effectiveness of sensing and computing facilities to supply the persons in need with smart assistance, by responding to their necessities of autonomy, independence, comfort, security and safety. The application scenarios addressed by AAL are complex, due to the inherent heterogeneity of the end-user population, their living arrangements, and their physical conditions or impairment. Despite aiming at diverse goals, AAL systems should share some common characteristics. They are designed to provide support in daily life in an invisible, unobtrusive and user-friendly manner. Moreover, they are conceived to be intelligent, to be able to learn and adapt to the requirements and requests of the assisted people, and to synchronise with their specific needs. Nevertheless, to ensure the uptake of AAL in society, potential users must be willing to use AAL applications and to integrate them in their daily environments and lives. In this respect, video- and audio-based AAL applications have several advantages, in terms of unobtrusiveness and information richness. Indeed, cameras and microphones are far less obtrusive with respect to the hindrance other wearable sensors may cause to one’s activities. In addition, a single camera placed in a room can record most of the activities performed in the room, thus replacing many other non-visual sensors. Currently, video-based applications are effective in recognising and monitoring the activities, the movements, and the overall conditions of the assisted individuals as well as to assess their vital parameters. Similarly, audio sensors have the potential to become one of the most important modalities for interaction with AAL systems, as they can have a large range of sensing, do not require physical presence at a particular location and are physically intangible. Moreover, relevant information about individuals’ activities and health status can derive from processing audio signals. Nevertheless, as the other side of the coin, cameras and microphones are often perceived as the most intrusive technologies from the viewpoint of the privacy of the monitored individuals. This is due to the richness of the information these technologies convey and the intimate setting where they may be deployed. Solutions able to ensure privacy preservation by context and by design, as well as to ensure high legal and ethical standards are in high demand. After the review of the current state of play and the discussion in GoodBrother, we may claim that the first solutions in this direction are starting to appear in the literature. A multidisciplinary debate among experts and stakeholders is paving the way towards AAL ensuring ergonomics, usability, acceptance and privacy preservation. The DIANA, PAAL, and VisuAAL projects are examples of this fresh approach. This report provides the reader with a review of the most recent advances in audio- and video-based monitoring technologies for AAL. It has been drafted as a collective effort of WG3 to supply an introduction to AAL, its evolution over time and its main functional and technological underpinnings. In this respect, the report contributes to the field with the outline of a new generation of ethical-aware AAL technologies and a proposal for a novel comprehensive taxonomy of AAL systems and applications. Moreover, the report allows non-technical readers to gather an overview of the main components of an AAL system and how these function and interact with the end-users. The report illustrates the state of the art of the most successful AAL applications and functions based on audio and video data, namely lifelogging and self-monitoring, remote monitoring of vital signs, emotional state recognition, food intake monitoring, activity and behaviour recognition, activity and personal assistance, gesture recognition, fall detection and prevention, mobility assessment and frailty recognition, and cognitive and motor rehabilitation. For these application scenarios, the report illustrates the state of play in terms of scientific advances, available products and research project. The open challenges are also highlighted. The report ends with an overview of the challenges, the hindrances and the opportunities posed by the uptake in real world settings of AAL technologies. In this respect, the report illustrates the current procedural and technological approaches to cope with acceptability, usability and trust in the AAL technology, by surveying strategies and approaches to co-design, to privacy preservation in video and audio data, to transparency and explainability in data processing, and to data transmission and communication. User acceptance and ethical considerations are also debated. Finally, the potentials coming from the silver economy are overviewed. (shrink)

Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

En la presente reflexión, se exponen algunos de los efectos jurídicos y procesales derivados de la Declaración Conjunta de Argyle por el Diálogo y la Paz entre Guyana y Venezuela (Declaración Conjunta, en adelante), publicada en San Vicente y Las Granadinas en fecha 14 de diciembre de 2023. Se analizan, de manera sucinta, las implicaciones procedimentales que la Declaración Conjunta, asumida como elemento material probatorio, genera a favor de la posición jurídica de Venezuela que puede promover, con base a una (...) serie de hechos nuevos de relevante valor y eficacia procesal, tanto la i) la excepción de inadmisibilidad sobrevenida de la demanda judicial que, por el territorio de la Guayana Esequiba, promueve Guyana contra Venezuela, en la Corte Internacional de Justicia (CIJ) dada la improcedencia de la misma y ii) la excepción de incompetencia sobrevenida de la CIJ para tramitar y decidir el litigio... El autor deja simplemente enunciado que, Generales del Derecho Internacional, concordados al artículo 52 de la CVDT y con la Declaración Conjunta de Argyle, es jurídicamente factible que Venezuela, conforme a los Principios el procedimiento de los artículos 65 y 66 ejusdem, promueva la nulidad absoluta retroactiva del Tratado Arbitral de Washington de 1897 y, de manera consecuencial, la nulidad absoluta retroactiva, ya reconocida, del Laudo Arbitral de París de 1899 por la coacción y la agresión y la invasión territorial que sirvieron de contexto y pretexto para su aprobación por parte de Venezuela, como medio para tratar de darle aparente legalidad a la ocupación militar ilegal de nuestro territorio Esequibo por parte del Reino Unido. The five legacies are: first, the upholding of an anti- revisionist standpoint; second, the development of the Maoist theory of a protracted people’s war; third, the advancement of a Marxist view on the peace talks; fourth, the promotion of a Marxist view of faith or religion as a force for social change; and fifth, the clarification of bureaucrat capitalism as a basis of fascism. The paper aims to further position Sison as an important theorist not only in the Philippines but also the world over, especially in the Global South. While there are many previous studies concerning Sison as a Marxist and nationalist scholar, this paper furthers existing literature especially in the context after Sison’s death last December 2022. Este manual sobre tecnologías para un envejecimiento activo y saludable, también conocido como Vida Asistida Activa (Active Assisted Living – AAL en sus siglas en inglés), ha sido creado como parte de la Acción COST GoodBrother, que se ha llevado a cabo desde 2020 hasta 2024. Las Acciones COST son programas de investigación europeos que promueven la colaboración internacional, uniendo a investigadores, profesionales e instituciones para abordar desafíos sociales importantes. GoodBrother se ha centrado en las cuestiones éticas y de privacidad (...) relacionadas con la monitorización empleando cámaras y micrófonos en entornos de provisión de cuidados. El objetivo ha sido garantizar que, mientras las tecnologías AAL ayudan a las personas mayores y a los individuos vulnerables, sus derechos de privacidad y protección de datos se mantengan como una prioridad. Este manual está diseñado para guiar en el papel que juegan las tecnologías AAL en la mejora de la calidad de vida de personas mayores, sus cuidadores y personas con discapacidades. Las tecnologías AAL ofrecen herramientas para quienes enfrentan desafíos cognitivos o físicos. Pueden mejorar la independencia, asistir en las rutinas diarias y promover un entorno de vida más seguro. Sin embargo, el aumento de estas tecnologías también plantea preguntas importantes sobre la protección de datos y la autonomía del usuario. A~través de estudios de casos prácticos, este manual explora escenarios reales en los que se aplican las tecnologías AAL. Ofrecen información sobre sus beneficios y desafíos. Se discuten situaciones en las que personas mayores han recuperado su sentido de independencia, por ejemplo, mediante el uso de sistemas de detección de caídas o dispositivos de monitorización de salud.
